The principal perpetrator is considered primarily responsible for the crime and is subject to the prescribed punishment. ✅2- The accomplice: The person who contributes to the crime indirectly, such as providing assistance, incitement, or agreeing with the principal perpetrator to commit the crime. The liability of the accomplice varies depending on the type and degree of their contribution to the crime. ✅3- The instigator: The person who incites another person to commit the crime. Instigation is considered one of the most severe forms of complicity in a crime, and the instigator may be punished with the same penalty as the principal perpetrator in some cases. ✅ 4- The Accomplice: A person who agrees with another person to commit a crime, even if they do not directly participate in its execution. Conspiracy to commit a crime is considered an independent crime in some cases. ✅ 5- The Assistant: A person who provides assistance to the principal before or during the commission of the crime, such as providing tools or information, or facilitating escape. Determining the role of each defendant in the crime depends on the evidence and circumstances surrounding the crime. Article 49 of Law No. 77 of 1943 regarding inheritance, amended by Law No. 219 of 2017, stipulates: “Without prejudice to any more severe penalty stipulated by another law, anyone who intentionally refrains from handing over to an heir his legal share of the inheritance, whether by consent or final judgment, shall be punished with imprisonment for a period of not less than six months and a fine of not less than twenty thousand pounds and not exceeding one hundred thousand pounds, or with one of these two penalties. The same penalty shall be imposed on anyone who withholds a document confirming the share of the heir or refuses to hand over that document upon request from any of the legal heirs or any competent authority. In the event of a return to any of the previous acts, the penalty shall be imprisonment for a period of not less than one year. The victim, his special agent, his heirs, or their special agent may prove reconciliation with the accused before the Public Prosecution or the court, as the case may be, in the misdemeanors stipulated in this article. The accused or his special agent may prove the reconciliation referred to in the previous paragraph.” This amendment has introduced three crimes and their penalties, which are: : ✅ First: The crime of intentionally refusing to hand over to an heir their legal share of the inheritance. The essence and essential element of this crime is the presence of criminal intent on the part of the accused, such that he intends to prevent the heir from being entitled to their share. ✅ Second: The crime of refusing to hand over documents proving entitlement to the inheritance. In this crime, the legislator stipulates that, before initiating a criminal case, the heir must have requested the document from the person in possession and refused to hand it over. This request and certain knowledge are established either by issuing an official warning by a bailiff or by registered letter with acknowledgment of receipt. Furthermore, in the event of a repeat offense, the prison sentence is increased to no less than one year. ✅ Third: The crime of withholding documents confirming the heirs' share, such as withholding the deceased's ownership contracts and the like.
