Learn more about the law⚖️ With the AL-SHOURA app ????⚖???? ✅Penalty for using someone else's national ID card in the law?! ✅The Civil Status Law has determined the penalty for the crime of using someone else's ID card or a person enabling another person to use his card in collusion. ✅Article 73 stipulates that without prejudice to any more severe penalty stipulated in the Penal Code or other laws, anyone who uses someone else's card or enables them to use their card in collusion shall be punished by imprisonment for a period of not less than one year and a fine of not less than five hundred pounds and not more than one thousand pounds, or one of these two penalties. ✅Article 1 of the law stipulates that the Civil Status Authority shall implement the provisions of this law and the Minister of Interior shall issue the necessary decisions to establish civil status information centers, stations for the automated issuance of identity cards and civil status documents, and civil registry departments and units in the entities he appoints. ✅Article 2 of the Civil Status Law stipulates that the Civil Status Authority shall establish a national database for citizens' data, including a special record for each citizen, distinguished by a national number from birth and throughout his life, and not repeated even after his death, and all parties are obligated to deal with the citizen through this number. ✅Divorce for absence, its conditions and legal basis?! ✅Articles 12 and 13 of Law No. 25 of 1929 organized the provisions of divorce for absence, as stated in Article 12: “If the husband is absent for a year or more without an acceptable excuse, his wife may ask the judge to divorce her irrevocably if she is harmed by his distance from her, even if he has money from which she can spend.” Article 13 stipulated: “If the messages can reach the absent person, the judge sets a deadline for him and excuses him that he will divorce her if he does not come to live with her or move her to him or divorce her. If the deadline expires and he does not do so and does not find an acceptable excuse, the judge separates them with an irrevocable divorce. If the messages cannot reach the absent person, the judge divorces her without excuses and sets a deadline.” Divorce due to absence in Egyptian law is requested by the Egyptian Muslim wife from the judiciary if she is harmed by her husband's absence from her for a year or more with an unacceptable excuse, even if she has money to spend from. The husband's absence means his absence in a country other than the one in which the wife resides. As for his residence in a house other than the marital home in the same country, it is one of the conditions that fall within the scope of harm and not absence. If the warning is issued and the person does not return the money, a lawsuit is filed against the owner of the number called "Unjust Enrichment Suit" or "Return of What Was Paid Unjustly" suit, and the court is requested to authorize the extraction of evidence of the transfer of money from the mobile company. It is also important to prove that there is no connection between you and the defendant, and to prove that he did not return the amount that was transferred by mistake, with a similarity between the number to which the money is to be transferred and the wrong number, the amount will be returned with compensation for the damages incurred by you when he refuses to return the amount he took without right. ✅The second way: The amount was transferred by mistake, and when you contacted him and demanded that he return the amount that was transferred to him by mistake, he refused to return it, and of course you do not have any data on him, neither his name nor his address nor any data related to the owner of the number to sue him What do you do?! ✅File a lawsuit in which you will sue the telecommunications company that manages the electronic wallet to which you sent the money by mistake.
