✅Learn more about the law⚖️ With the Al-Shoura app ✅The crime of refusing to hand over an inheritance?!! Article 49 of Law No. 77 of 1943 regarding inheritance, amended by Law No. 219 of 2017, stipulates: “Without prejudice to any more severe penalty stipulated by another law, anyone who intentionally refrains from handing over to an heir his legal share of the inheritance, whether by consent or final judgment, shall be punished with imprisonment for a period of not less than six months and a fine of not less than twenty thousand pounds and not exceeding one hundred thousand pounds, or with one of these two penalties. The same penalty shall be imposed on anyone who withholds a document confirming the share of the heir or refuses to hand over that document upon request from any of the legal heirs or any competent authority. In the event of a return to any of the previous acts, the penalty shall be imprisonment for a period of not less than one year. The victim, his special agent, his heirs, or their special agent may prove reconciliation with the accused before the Public Prosecution or the court, as the case may be, in the misdemeanors stipulated in this article. The accused or his special agent may prove the reconciliation referred to in the previous paragraph.” This amendment has introduced three crimes and their penalties, which are: : ✅ First: The crime of intentionally refusing to hand over to an heir their legal share of the inheritance. The essence and essential element of this crime is the presence of criminal intent on the part of the accused, such that he intends to prevent the heir from being entitled to their share. ✅ Second: The crime of refusing to hand over documents proving entitlement to the inheritance. In this crime, the legislator stipulates that, before initiating a criminal case, the heir must have requested the document from the person in possession and refused to hand it over. This request and certain knowledge are established either by issuing an official warning by a bailiff or by registered letter with acknowledgment of receipt. Furthermore, in the event of a repeat offense, the prison sentence is increased to no less than one year. ✅ Third: The crime of withholding documents confirming the heirs' share, such as withholding the deceased's ownership contracts and the like. ✅Learn more about the law⚖️ With the Al-Shoura app ✅Is it permissible for a husband, if his wife refuses to implement the visitation order, to resort to the judiciary to claim compensation?!! ✅Compensation claims for failure to implement visitation rights are common in personal status courts, especially given the high number of marital separations, whether through divorce or khul'. This results in the mother assuming custody of the children without the father, who thus retains the right to visitation rights. Decision No. 1086 of 2000 of the former Minister of Justice regulates visitation rights, with the duration being no less than three hours once a week, in a public place that does not harm the child's interests. Article 96 of Law No. 126 of 2008 stipulates that depriving someone with the right to visit children constitutes the crime of exposing a child to danger. However, it exempts this crime from punishment, and it is considered a moral crime, not a punishable crime, meaning it is a moral violation. ✅Learn more about the law⚖️ With the Al-Shoura application ✅Multiple defendants in crimes, their roles, and responsibilities in a single crime?!! ✅The roles of defendants may be multiple, and their criminal responsibilities vary depending on their role in committing the crime. These roles are defined by criminal laws and clarify the extent of each person's contribution to the criminal act. It consists of the following main roles for each defendant: ✅1- The principal perpetrator: The person who directly commits the physical act constituting the crime. The principal perpetrator is considered primarily responsible for the crime and is subject to the prescribed punishment. ✅2- The accomplice: The person who contributes to the crime indirectly, such as providing assistance, incitement, or agreeing with the principal perpetrator to commit the crime. The liability of the accomplice varies depending on the type and degree of their contribution to the crime. ✅3- The instigator: The person who incites another person to commit the crime. Instigation is considered one of the most severe forms of complicity in a crime, and the instigator may be punished with the same penalty as the principal perpetrator in some cases. ✅ 4- The Accomplice: A person who agrees with another person to commit a crime, even if they do not directly participate in its execution. Conspiracy to commit a crime is considered an independent crime in some cases. ✅ 5- The Assistant: A person who provides assistance to the principal before or during the commission of the crime, such as providing tools or information, or facilitating escape. Determining the role of each defendant in the crime depends on the evidence and circumstances surrounding the crime. The judge assesses these roles and determines the criminal liability of each defendant based on the law. ⚖️Your legal consultation with a specialized lawyer greatly protects you from any risks⚖️ Mr. Mohamed Hesham El-Sayed Lawyer at the High Court of Appeal and the State Council⚖️ ✅We always strive to provide the best legal service⚖ ✅Lawyer anywhere in Egypt ✅24-hour technical support ✅ Find your lawyer
✅Learn more about the law⚖️ With the AL-SHOURA app ✅Everything you need to know about dismissal?! ✅Has your lawsuit been dismissed? Don't worry! We'll walk you through all the important details in simple, clear steps! ✅First: What does dismissal mean? It simply means removing the case from the case roll. This means that the court will not hear it again unless one of the parties notifies the other party of the renewal of the case, so that they can return it to the court. ✅Second: What is the renewal deadline? The case must be renewed within 60 days from the day following the date of the dismissal decision. If you miss the deadline, unfortunately, you could lose your case! ✅Third: What happens after the renewal? If no one appears after the renewal of the case, it is considered "nonexistent" and you did nothing! However, if the case is valid for judgment (meaning all parties have submitted their statements and defenses), the court can rule on it even if no one attended the hearing! If the court decides to dismiss the case even though it is valid for judgment, this decision is considered invalid! In this case, either party has the right to request that the case be retried without adhering to the 60-day deadline. ✅ Golden Tips: * Keep track of your court dates carefully. If a dismissal occurs, hurry up and submit a renewal notice before the specified date! If the case is ready for judgment, don't delay in following up to avoid an incorrect dismissal! The Tax Authority determined that there had been an actual sale and imposed a real estate transaction tax of 75,000 pounds, and his bank account was seized to cover this amount. ✅A simple mistake cost him 75,000 pounds!
